AMENDED ORDER
WHEREAS a hearing into Notice of Proposal number 17306 dated June 12, 2009, to suspend liquor licence number 805164, issued to Rockwood Nightclub Inc. (the “Licensee”), operating as ROCKWOOD/GRASS, 31 Mercer Street, Toronto, Ontario, M5V 1H2, on the basis of an alleged violation of subsection 45(1) of Ontario Regulation 719/90 (the “O.Reg”) made pursuant to the Liquor Licence Act, was held on September 24, 2009, in the City of Toronto;
AND WHEREAS in its Decision dated November 5, 2009 the Board found the Licensee violated subsection 45(1) of the O.Reg in respect of one patron on December 6, 2008;
AND WHEREAS in its Decision dated December 17, 2009 the Board ordered a FOURTEEN (14) day suspension of the liquor licence and thereafter the Licensee proposed suspension dates acceptable to the Board;
AND WHEREAS in its Order of January 28, 2010, the Board ordered the suspension period to be served from 11:00 a.m. on March 1, 2010 and continue until 2:00 a.m. on March 15, 2010;
AND WHEREAS on March 1, 2010 the Licensee, through its representative, Nicholas Macos, sought an amendment of the suspension dates and the Registrar's representative, Phillip Morris, did not oppose the request for an amendment;
THEREFORE the Board hereby ORDERS that liquor licence number 805164, issued to Rockwood Nightclub Inc., operating as ROCKWOOD/GRASS, 31 Mercer Street, Toronto, Ontario, M5V, be SUSPENDED for FOURTEEN (14) consecutive days to COMMENCE at 11:00 a.m. on March 3, 2010 and continue until 2:00 a.m. on March 17, 2010.
