AMENDED ORDER
WHEREAS a hearing into a Notice of Proposal number 16096 dated March 12, 2008, to suspend liquor licence number 20092, issued to 501250 Ontario Inc., operating as WALLY’S ROADHOUSE, 2532 – 2536 Innes Road, Gloucester, Ontario, K1B 4C5, on the basis of alleged violations of subsections 30(2) and 30(4) of the Liquor Licence Act (the “LLA”) and subsections 41(1) and 45(1) of Ontario Regulation 719/90 made pursuant to the LLA, was held on August 28, 2008 in the City of Ottawa;
AND WHEREAS in its Decision of December 9, 2008 the Board found that the Licensee had breached subsection 30(4) of the LLA;
AND WHEREAS in its Decision of January 30, 2009 the Board ordered a SEVEN (7) day suspension of the liquor licence;
AND WHEREAS in its Order of February 11, 2009, the Board ordered the suspension period to be served from 11:00 a.m. on April 24, 2009 and continue until 2:00 a.m. on May 1, 2009;
AND WHEREAS the Licensee appealed the Board’s Decision to the Ontario Superior Court of Justice (“Divisional Court”) and by an Order, the Court stayed the period of suspension of the licence pending the outcome of the appeal;
AND WHEREAS the appeal was dismissed by the Divisional Court in its written endorsement of its Oral Order;
AND WHEREAS the Licensee has proposed new suspension dates which are acceptable to the Board;
THEREFORE the Board hereby ORDERS that liquor licence number 20092, issued to 501250 Ontario Inc., operating as WALLY’S ROADHOUSE, 2532 – 2536 Innes Road, Gloucester, Ontario, K1B 4C5, be SUSPENDED for SEVEN (7) consecutive days to commence at 11:00 a.m. on June 20, 2010 and continue until 2:00 a.m. on June 27, 2010.
