The applicant brought a matter before the Ontario Labour Relations Board against the responding union.

The applicants filed applications under section 68 of the Employment Standards Act requesting a review of an Employment Standards Officer's decisions.

The Board noted that the Ministry of Labour had not forwarded all requested documents, including the order to pay and the officer's narrative report.

The Board directed the Ministry and one of the applicants to provide the missing documents forthwith and directed the Registrar to process the applications in the normal course.

The Service Employees International Union applied for certification.

A representation vote was held, and not more than 50% of the ballots were cast in favour of the applicant.

No statement of desire to make representations was filed.

The Ontario Labour Relations Board dismissed the application and directed the parties' attention to section 10(3) of the Act regarding subsequent applications.

The applicant union referred a grievance to arbitration under section 133 of the Labour Relations Act, 1995.

Prior to the hearing, the parties entered into Minutes of Settlement.

The Board issued a consent order declaring that the responding party was bound by the collective agreement and had violated it by failing to make timely remittances to the union's health, welfare, and pension funds.

The Board ordered the responding party to pay $15,570.03 in outstanding remittances, $989.65 in liquidated damages, and $214.00 for the union's filing fees.

The applicant applied to review an order to pay under the Employment Standards Act.

The order was for $708.00, but the applicant only paid $217.60 into trust.

The Board directed the applicant to provide evidence of full payment by October 28, 2001, failing which the application would be automatically terminated.

The applicant filed a termination application seeking to decertify the union, and a representation vote was held where two individuals voted against continued representation.

The union also referred a construction grievance to arbitration and sought to have it determined before the termination application.

The Board declined to consolidate the applications or determine the order of proceedings at this stage, instead setting both matters down for a one-day hearing where the assigned panel will determine the manner of proceeding.

The applicant appealed an Order to Pay under section 68 of the Employment Standards Act.

The workplace parties entered into Minutes of Settlement.

The Board ordered the funds held in trust by the Director to be disbursed according to the settlement, with $5,000 paid to the applicant, $5,000 paid to the responding employee, and the $1,000 administration fee retained by the Consolidated Revenue Fund.

The applicant sought an adjournment of the hearing.

Having regard to the agreement of the parties, the Board adjourned the hearing to a date to be set by the Registrar.

The Civic Institute of Professional Personnel requested an adjournment of the scheduled hearing.

Despite opposition, the Ontario Labour Relations Board granted the adjournment after considering the parties' submissions regarding timelines and variations from their agreement.

The hearing was rescheduled to July 20, 2001.
