DECISION OF THE BOARD; November 5, 2001
1These are employee applications filed pursuant to section 68 of the Employment Standards Act (the “Act”) requesting review of the Employment Standards Officer, Gerry LaLonde’s decisions dated August 27, 2001.
2On October 11, 2001 the Registrar requested the Ministry of Labour or provide a copy of the order to pay, the officer’s narrative report and the officer’s work sheets (where applicable). The Ministry of Labour has not forwarded all of the requested documents as of the date of this decision. The Board hereby directs the Ministry of Labour to provide the documents requested forthwith.
3The Employment Standards Officer amended his assessment as set out in his letter addressed to Monica Dillon, dated October 12, 2001. A copy of that letter has been filed with the Board in Board File No. 1905-01-ES.
4From correspondence dated October 25, 2001 from Laura Wingeat (Board File No. 1904-01-ES) it appears that a similar re-assessment was made to the entitlement of Ms. Wengeat. Ms Wingeat’s letter states: “A copy of the letter he (Mr. Lalonde) sent me was delivered to the Registrar of the Labour Relations Board on October 18th.”
5There is no copy of the letter referred to by Ms. Wingeat in the file. The Board hereby directs the Ministry of Labour and Ms. Wingeat to provide the Board with that document forthwith.
6In light of the reassessment by the Employment Standards Officer the applicants have requested to amend their applications with respect to the remedy they are seeking as set out in the correspondence of October 25, 2001.
7The Registrar is directed to process these applications in the normal course.
