The applicant, who was catastrophically impaired following a motor vehicle accident, sought entitlement to various housekeeping, home maintenance, and massage therapy expenses, as well as a $277,895.75 treatment plan for assistive devices including a tractor and snow blower.

The Licence Appeal Tribunal dismissed the application in its entirety.

The appellants appealed a decision by Tarion Warranty Corporation denying their claim for a refund of deposits and delayed occupancy compensation regarding a new condominium townhome.

The appellants argued the builder fundamentally breached the purchase agreement due to multiple occupancy delays and by terminating the agreement.

The Licence Appeal Tribunal found that the delays were permitted unavoidable delays under the agreement and did not constitute a fundamental breach.

Instead, the appellants fundamentally breached the agreement by repeatedly failing to pay the required deposits, entitling the builder to terminate the contract and retain the deposits.

The claim for delayed occupancy compensation was also dismissed as closing did not occur and the delay did not exceed the outside occupancy date.

The appellant requested a reconsideration of a Tribunal decision that confirmed the suspension of his Class A driver's licence.

The appellant appealed a Notice of Proposal to suspend its liquor licence for 60 days following a fatal motor vehicle accident involving a patron.

The patron had consumed 10 ounces of alcohol at the licensed premises in under an hour before driving the wrong way on a highway and colliding with a transport truck.

The Tribunal found that the appellant permitted alcohol to be sold to an intoxicated person, permitted intoxication on the premises, allowed an uncertified bartender to serve alcohol, and served alcohol after hours.

The appeal was dismissed and the Registrar was directed to carry out the 60-day licence suspension.

The respondent argued the claim was barred by res judicata, as a previous application for a special award regarding a different treatment plan had been dismissed.

The Tribunal found that issue estoppel did not apply because the applications concerned different treatment plans.

On the merits, the Tribunal dismissed the claim for a special award, finding the three-and-a-half-month delay in approving the plan was not excessive, imprudent, or in bad faith.

The respondent's request for costs was also dismissed, as the applicant's conduct was not frivolous or vexatious.
