The respondent denied several treatment plans for physiotherapy and psychological services on the basis that the applicant's injuries fell within the Minor Injury Guideline (MIG).
The applicant argued for removal from the MIG due to chronic pain and psychological impairments.
The Tribunal found that the applicant's physical injuries were predominantly minor sprains and strains, and that the medical evidence did not support a diagnosis of chronic pain.
Furthermore, relying on the respondent's psychological assessment which indicated non-credible reporting of symptoms, the Tribunal concluded the applicant did not suffer from a psychological condition warranting removal from the MIG.
The Tribunal also found the respondent's denial letter complied with the requirements of s. 38(8) of the Schedule.
The application was dismissed.
