The defendant was charged with sexual assault and forcible confinement following an incident in November 2021 where he sexually assaulted his roommate despite her prior and explicit rejection of his advances.

The defendant pleaded not guilty and applied for a verdict of not criminally responsible by reason of mental disorder (NCRMD) under section 16 of the Criminal Code.

The Crown conceded that the defendant suffered from a qualifying disease of the mind, but contested whether he was incapable of appreciating the nature and quality of his actions or knowing they were wrong.

The court found that while the defendant suffered from a mental disorder, the evidence was insufficient to establish that he lacked the requisite capacity under section 16, and therefore rejected the NCRMD application.

The Crown sought to have Adam Nevills declared a Dangerous Offender under s. 753 of the Criminal Code following his conviction for sexually assaulting an elderly woman during a break and enter.

The court conducted a two-stage analysis, focusing on designation and sentencing.

While the court found Nevills presented a high likelihood of harmful recidivism, it was not convinced beyond a reasonable doubt that his conduct was intractable, citing some prospect of treatability through a highly structured federal correctional program, the link between his offending and drug use (which could be monitored), and the anticipated effects of aging.

Consequently, the court declined to designate him a Dangerous Offender, instead designating him a Long Term Offender under s. 753(5)(a) of the Criminal Code.

Melissa Miller pleaded guilty to careless driving causing death under the Highway Traffic Act after texting while driving, resulting in the death of a cyclist.

The court considered significant mitigating factors, including her remorse, lack of criminal record, community involvement, and immediate assistance at the scene, alongside aggravating factors such as a prior HTA offence, texting in a construction zone, and the vulnerability of the cyclist.

The Crown sought the maximum sentence (2 years jail, 5 years license suspension, 2 years probation), while the Defence urged a non-custodial sentence.

The court emphasized proportionality, denunciation, and general deterrence, distinguishing between regulatory and criminal offence sentencing principles.

The final sentence imposed was 45 days jail and a 2-year driver's license suspension, with no probation.

The defendant, Patrick Morgan, was found guilty of sexual assault involving unprotected intercourse with a profoundly intoxicated victim (K.L.) whom he had initially tried to help.

The court considered the seriousness of the offence, the breach of trust, the mens rea of recklessness, and significant mitigating factors including the defendant's youth, lack of criminal record, remorse, and personal hardships.

The Crown sought 12-18 months institutional incarceration, while the defence argued for a conditional discharge.

The court found that a conditional discharge was contrary to public interest due to the need for denunciation and general deterrence, but also that traditional incarceration was not fully appropriate given the unique circumstances and the defendant's strong rehabilitative prospects.

A conditional sentence of 16 months was imposed, to be served in the community with electronic monitoring, followed by 18 months probation.

The Crown alleged that the defendant operated a motor vehicle while impaired by drugs on July 16, 2018, following a motor vehicle collision in London, Ontario.

The defendant was arrested after an Approved Screening Device test showed zero alcohol content.

A Drug Recognition Evaluator concluded the defendant was impaired by narcotic analgesics and cannabis.

The defendant testified he had not consumed impairing drugs prior to driving.

The court found that while the defendant's ability to operate a motor vehicle may have been impaired, the Crown failed to prove this beyond a reasonable doubt.

The defendant was acquitted.
