The court held that the respondent in the main proceeding was successful overall on the most important and time-consuming issues, notwithstanding partial lack of success on the restraining order claim.
Applying the Family Law Rules costs framework, the court considered success, formal and informal offers to settle, party conduct, proportionality, reasonableness, and the self-represented party’s ability to pay.
The court found a fair and reasonable award was $42,000 inclusive of disbursements and HST, payable within 90 days.
