The County of Elgin appealed a Justice of the Peace's decision to apply the Kienapple principle, resulting in only one conviction for driving under suspension despite two distinct suspensions.

The respondent's driver's license was suspended for unpaid fines and separately for an outstanding debt to the Motor Vehicle Accident Claims Fund.

The appeal court found that the trial justice erred by improperly applying the Kienapple principle, as there were distinguishing factual and legal elements between the two suspensions, representing distinct delicts.

The court granted the appeal, registered the second conviction, and remitted the matter for sentencing.

The applicant, James McLeod, brought a motion for a stay of proceedings under section 11(b) of the Charter due to unreasonable delay.

The total delay from the information being sworn to the anticipated trial completion was 677 days, exceeding the 18-month presumptive ceiling for the Ontario Court of Justice.

The court attributed 159 days of delay to the defence as an implicit, clear, and unequivocal waiver during resolution discussions, where the defence prioritized seeking a favourable resolution over asserting the right to a timely trial.

An additional 129 days were attributed to the defence for failing to proactively raise s. 11(b) concerns in a timely manner after trial dates were set, which prevented the Crown from mitigating the delay.

After deducting these periods, the net delay was 389 days, falling below the presumptive ceiling.

Consequently, the application for a stay of proceedings was dismissed.

Kristen Nagle appealed her conviction and $10,000 fine for attending a religious observation with more than ten persons, an offence under the Reopening Ontario Act during the Covid-19 pandemic.

She argued that the Justice of the Peace failed to provide reasonable assistance to her as an unrepresented accused and failed to raise a Charter issue.

The court dismissed the conviction appeal, finding that the trial justice's assistance was reasonable given Nagle's deliberate use of Organized Pseudo-legal Commercial Arguments (OPCA) tactics, and that no miscarriage of justice occurred.

However, the court allowed the sentence appeal, reducing the fine to $3,750 (plus costs and surcharges), finding the original reasons for sentence insufficient for meaningful review and considering new biographical information and aggravating factors.

The appellant, a novice driver, appealed his conviction for operating a motor vehicle while holding a cellular phone, arguing his guilty plea (made by paying the fine) was uninformed because he was unaware of the automatic 30-day licence suspension that followed.

The court dismissed the appeal, distinguishing the licence suspension as a direct consequence of the Highway Traffic Act (HTA) regulatory scheme, rather than a collateral consequence that would invalidate the plea.

The court emphasized that drivers are expected to be aware of the consequences within the highly regulated driving regime and that the simplified plea process under the Provincial Offences Act (POA) is intended for efficiency, making it rare to set aside a plea on "fundamental fairness" grounds for readily discernable penalties.

Ryan Burke appealed his conviction for transporting cannabis in a motor vehicle contrary to s. 12(1) of the Cannabis Control Act.

The appeal raised four grounds related to the statutory interpretation of "baggage" and "fastened closed" under s. 12(2)(b) of the Act.

The court dismissed the appeal, finding that the trial judge correctly applied the modern approach to statutory interpretation, did not err in defining "baggage" to exclude small pill bottles or the vehicle's center console, and was not required to make findings on whether the containers were "fastened closed" once they were determined not to be "baggage."

Krystle Oag pleaded guilty to 37 offences, including 30 counts of break and enter, committed over 15 months.

The offences involved targeting residences of individuals attending funerals, preying on their emotional vulnerability.

Stolen items included firearms, some unrecovered.

The Crown sought a global sentence of 5.5 to 6 years, while the defence requested a time-served disposition or a conditional sentence, citing addiction and harsh pre-sentence custody conditions.

The court found the offences to be of extremely high gravity with high moral blameworthiness, aggravated by the targeting of vulnerable victims and the theft of firearms.

Mitigating factors included an early guilty plea and a limited criminal record.

The court imposed a global sentence of six years, reduced to five and a half years (66 months) due to the particularly harsh pre-sentence custody conditions, resulting in a net sentence of 1,101 days.

A conditional sentence was deemed inappropriate given the seriousness of the crimes.

The accused was charged with driving with a blood alcohol concentration exceeding the legal limit contrary to section 253(1)(b) of the Criminal Code.

Following a trial on December 19, 2019, the court reserved judgment.

The accused brought a Charter application alleging a breach of section 10(b) rights (right to counsel).

The court also raised concerns about section 7 and 11(d) Charter violations based on the credibility and reliability of the police officer's testimony.

The section 10(b) application was dismissed, but the court found that the officer's misleading and evasive testimony during trial constituted an abuse of process violating sections 7 and 11(d) of the Charter.

As a result, the breath evidence was excluded, leading to an acquittal.
