Horse racing interference appeal allowed in part; suspension waived but horse placement upheld.

The appellants appealed a 3-day driving suspension and the placement of their horse from first to third for causing interference during a race.

The Ontario Racing Commission panel reviewed the video replay and testimony, finding that interference did occur as the driver initiated hooking of the arches.

However, given the closeness of the call and the difficulty in adjudicating the interference, the panel waived the 3-day driving suspension while upholding the horse's placement.

The applicant, a standardbred licensee previously suspended for a third positive human drug test and other issues, applied for reinstatement of his license.

The Ontario Racing Commission granted the application subject to strict conditions, including the payment of outstanding fines and the completion of a Substance Abuse Professional assessment.

The Commission imposed a stepped reinstatement program, allowing the applicant to first apply for a groom's license, followed by an assistant trainer's license after one year, and a full trainer's license after two years, provided he maintains a clean record and receives approval for his employers.

Appeal of horse's ineligibility due to race office error denied; trainer awarded $300 hitching fee.

The appellant, a standardbred licensee and trainer, appealed a ruling that declared his horse ineligible to race.

The horse was properly entered but missed in error by the race office.

Because the field was full and it was an overnight event, the judges declared the horse ineligible pursuant to Rule 17.15(a)(i) of the Rules of Standardbred Racing.

The Ontario Racing Commission denied the appeal, finding the rule was properly applied, but ordered that the appellant receive a $300 hitching fee from the purse account and referred the race office's error back to the judges for appropriate action.

Appeal allowed; appellant entitled to frozen purse winnings following bona fide horse ownership transfer.

The appellant, Aaron Waxman, appealed a decision of the Ontario Racing Commission Judges to freeze $12,500 in purse winnings accrued by his horse, Jinglejanglejingle.

The purse was frozen following the suspension of the appellant's brother, who previously co-owned the horse.

The Panel found that a bona fide transfer of ownership to the appellant had occurred prior to the races in question, and the Judges had not required prior approval for this transfer.

The appeal was allowed, and the appellant was entitled to the purse winnings.

Stay of horse racing licensee's suspension extended pending rescheduled hearing.

The licensee requested a further stay of a ruling that suspended his owner's licence for 12 months and imposed an $8,000 fine.

The stay was previously granted on the condition that the hearing commence by August 31, 2011.

As the hearing was rescheduled to September 7, 2011, the Chair of the Ontario Racing Commission extended the stay until the commencement of the rescheduled hearing.

The appellants appealed a Stewards' ruling that suspended a jockey for three days and placed a horse 8th for a rule violation.

At the hearing, a properly served witness for the Administration failed to appear.

The Commission Chair adjourned the hearing to a later date when the witness could be made available and referred the witness's failure to appear to the Administration for investigation.

Appeal of $200 fine for starting gate violation denied as driver was unaware of broken equipment.

The appellant, a standardbred licensee, appealed a $200 fine for failing to come up and remain on the starting gate in violation of Standardbred Rule 22.03(j)(vii).

The appellant argued that his horse had lost a shoe, but the Panel found he was off the gate and would not have known about the broken equipment at the time.

The appeal was denied, though the Panel directed the judges to consult with drivers regarding ongoing frustrations with the starting gate process.

Apprentice jockey reinstated as exercise rider with conditions following suspension for positive marijuana test.

The licensee, an apprentice jockey, was suspended after testing positive for marijuana.

He applied for reinstatement and completed a return-to-duty test.

The Ontario Racing Commission ordered that he could be licensed as an exercise rider for one year, subject to paying all outstanding fines, entering a two-year post-violation agreement, and being subject to random testing.

Any future positive test would result in an automatic one-year suspension.

License reinstatement hearing adjourned due to outstanding arrest warrant in another jurisdiction.

The licensee, a jockey, sought reinstatement of his thoroughbred racing license after providing a negative urine sample.

At the commencement of the hearing, the Administration advised that there was an outstanding warrant for the licensee's arrest in Miami Dade County.

The Commission ruled that the hearing could not proceed until the outstanding warrant was dealt with, as the warrant prevented him from being licensed.

The hearing was adjourned.

Appeal of fine for delaying race upheld; $200 fine imposed for late reporting to paddock.

The appellant, a standardbred licensee, appealed a $100 fine for delaying the start of a race under Rule 22.03(j)(i).

Following a de novo hearing, the Ontario Racing Commission upheld the appeal regarding the delay.

However, the Commission found the appellant in violation of Rule 25.10 for failing to report to the horse two minutes prior to the post-parade.

The appellant was fined $200 for the late reporting violation.

Appeal of race judges' decision denied; driver was forced off track by appellant.

The appellant, a standardbred licensee, appealed an official ruling that found another driver did not violate the pylon rule during a race.

The appellant argued that the other driver went inside a pylon and should have been penalized.

The Ontario Racing Commission reviewed the race film and testimony, concluding that the appellant had moved off the rail, allowing the other driver room, and then moved back down, forcing the other driver off the track.

The appeal was denied as the Judges correctly applied the rule regarding being forced off the track.

Appeal of horse placement denied; horse caused interference by slowing up in the first turn.

The licensee appealed a Judges' ruling that placed his horse from 4th to 7th for causing confusion and interference to other horses during a race at Flamboro Downs.

The Ontario Racing Commission found that the licensee's horse slowed up in the first turn, causing interference in violation of the Rules of Standardbred Racing.

The appeal was denied.

Hanover Raceway appealed a decision denying its request to conduct Signature level standardbred race programs.

Prior to the hearing, Hanover withdrew its appeal.

The Ontario Racing Commission accepted the withdrawal on consent and ordered Hanover to pay $500 in costs to the Commission pursuant to its Rules of Procedure regarding appeal withdrawals, reducing the standard amount due to mitigating factors.

Horse racing licensee's penalties for public obscene gestures varied; fine upheld but suspension modified.

The appellant, a licensed driver, trainer, and owner, appealed penalties imposed by the Judges for conduct violations after he made obscene gestures towards them in full public view.

The Ontario Racing Commission varied the penalties, upholding the $5,000 fine and the forfeiture of $61,140 in purse monies, but immediately reinstating his owner/trainer licenses.

His driver's license remained suspended pending successful completion of an anger management program.

Appeal of $200 fine for lacking a written contract and complaint regarding scratched horse dismissed.

The appellants, a standardbred owner and a driver/trainer/owner, appealed a $200 fine for failing to have a written contract for a horse and the decision of the ORC Executive Director not to take further action against a track official who scratched their horse from a race.

The Ontario Racing Commission dismissed the appeal, finding that the trainer admitted to not having a written contract in violation of the rules, and that the appellants failed to exercise their rights of appeal in a timely manner regarding the scratched horse.

Harlequin Ranches appealed a decision of the Woodbine Racetrack Stewards concerning a claim of foul in a thoroughbred race.
