COMMISSION HEARING TORONTO, ONTARIO – JULY 5, 2011

AND RENE HUNDERUP
On May 22, 2011, the Stewards issued Thoroughbred Official Ruling TB 7048 wherein Sunny Singh (“Singh”) was given the penalty of a three-day riding suspension and the horse “Lady Celia” which finished 2nd was placed 8th for violation of Thoroughbred Rule 11.07 in the run from the gate during the first race at Fort Erie Racetrack on May 17, 2011.
On May 23, 2011, Jockey Singh, Trainer Julie Robillard and Owner Rene Hunderup filed a Notice of Appeal, pursuant to Rule 13.17(b) of the Rules of Thoroughbred Racing.
On July 05, 2011, a Panel of the ORC, comprised of Commission Chair Rod Seiling, convened for the purposes of hearing this matter.
Neil McCoag appeared on behalf of the Administration of the ORC. Singh, Julie Robillard and Rene Hunderup attended the Hearing and were unrepresented.
In the absence of witness Marni Williams the Panel adjourned the hearing until a later date when Marni Williams could be made available to attend the hearing.

MR. MCCOAG: It was the intention of the Administration to call two witnesses, Steward Bill McMahon and jockey Marni Williams. Marni Williams was properly served, however, she has since moved, I understand, her profession to Vancouver. She has not made the office aware of why she is not here and I think we need to make note of that and deal with that at a future time.
MR. CHAIRMAN: I can deal with that very quickly. I can tell you that I will refer Ms. Williams' failure to deal with her properly served notice back to the Administration and they can proceed to open an investigation and deal with it as they see fit.
MR. MCCOAG: Okay, thank you.
