COMMISSION HEARING TORONTO, ONTARIO – JULY 5, 2011
IN THE MATTER OF THE RACING COMMISSION ACT S.O. 2000, c.20;
AND IN THE MATTER OF THE APPEAL AND REQUEST FOR HEARING BY
THOROUGHBRED LICENSEE NORMAN MCKNIGHT
On May 25, 2011, the Stewards issued Thoroughbred Official Ruling TB 7054 wherein the horse “Kleinsridge” finished 2nd and was placed 7th for causing interference with the outside horse “True Bellamy” in the stretch run of the third race at Woodbine Racetrack on May 23, 2011, in violation of Thoroughbred Rules 11.07, 11.12, 11.14, 13.17, 13.17.02, 13.17.03 and 13.17.05.
On May 26, 2011, Trainer Norman McKnight (“McKnight”) filed a Notice of Appeal, pursuant to Rule 13.17(b) of the Rules of Thoroughbred Racing.
On July 05, 2011, a Panel of the Ontario Racing Commission (“ORC”) comprised of Commission Chair Rod Seiling, convened for the purpose of hearing this matter.
Neil McCoag appeared on behalf of the Administration of the ORC. McKnight attended the Hearing and was unrepresented.
After reviewing the evidence, hearing the testimony of Steward Richard Grubb, Jockey Gerry Olguin and McKnight and upon considering the closing submissions, the Panel allowed the appeal.
