The Ontario Review Board held an annual hearing to review the Disposition of the accused, who was found not criminally responsible for violent offences.
The accused, diagnosed with schizophrenia and antisocial personality disorder, had shown improvement on clozapine but remained a significant threat to public safety.
The Board continued the detention order with increased privileges, including indirectly supervised community passes.
However, applying the factors in s. 672.54 and the Sookram decision, the Board declined to include a community living term, finding no immediate prospect of discharge, no waitlist necessity, and a risk that unmet expectations could increase the accused's frustration and risk of violence.
