The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the liquor licence of the Riverbend Pub & Dining following a fatal snowmobile accident involving a patron.
The allegations included permitting drunkenness, permitting disorderly conduct, altering the premises without consent, and purchasing liquor off-licence.
The Board found insufficient evidence to establish that the patron was intoxicated while at the establishment or that the licensee permitted drunkenness or disorderly conduct, noting inconsistencies in witness testimony and delays in the police investigation.
The Board also dismissed the allegation regarding unauthorized alterations, finding the licensee took immediate steps to apply for the change when notified.
However, the Board found that the licensee violated the regulations by purchasing liquor off-licence.
The matter was deferred for written submissions on penalty.
