O R D E R
WHEREAS a hearing into Notice of Proposal number 17828 (the “NOP”) dated January 19, 2010, to suspend liquor licence number 20976 issued to 1654642 Ontario Inc. (the “Licensee”) operating as BURWELL’S COVE RESTAURANT & BAR, 33 Robinson Street, Port Burwell, Ontario, N0J 1T0, on the basis of alleged violations of section 29 and subsection 30(4) of the Liquor Licence Act (the “LLA”) and subsections 41(1) and 45(1) of Ontario Regulation 719/90 (“O.Reg”) made pursuant to the LLA, was held on January 6, 2011, in the City of London;
AND WHEREAS in its decision of March 28, 2011 the Board found that the Licensee had breached subsection 30(4) of the LLA and subsections 41(1) and 45(1) of the O.Reg;
AND WHEREAS in its decision of May 11, 2011 the Board ordered a TEN (10) day suspension of the liquor licence and requested that the Licensee propose suspension dates;
AND WHEREAS the Licensee did not submit proposed dates for the suspension. In normal circumstances, the Board would impose suspension dates. That is not the case here;
AND WHEREAS the Registrar’s representative informed the Board that the licence has not been renewed and has therefore been cancelled;
THEREFORE, because the licence no longer exists, a suspension of the licence is moot.
