O R D E R
WHEREAS a hearing into Notice of Proposal number 18185 (“NOP”) dated July 5, 2010, to suspend liquor licence number 803511 issued to 1499532 Ontario Inc. (the “Licensee”) operating as NIKKI’S SPORTS GALLERY, 14 Mountjoy Street South, Timmins, Ontario, P4N 1S4, on the basis of alleged violations of section 45.1 and subsection 45(1) of Ontario Regulation 719/90 (the “O.Reg”) made pursuant to the Liquor Licence Act (the “LLA”), was held on December 8, 2010, in the City of Timmins;
AND WHEREAS in its decision of January 17, 2011 the Board found that the Licensee had breached section 45.1 and subsection 45(1) of the O.Reg;
AND WHEREAS in its decision of April 14, 2011 the Board ordered a SIX (6) day suspension of the liquor licence and requested that the Licensee propose suspension dates;
AND WHEREAS the Licensee has proposed suspension dates which are acceptable to the Board;
THEREFORE the Board hereby ORDERS that liquor licence number 803511 issued to 1499532 Ontario Inc. operating as NIKKI’S SPORTS GALLERY be SUSPENDED for SIX (6) consecutive days to COMMENCE at 11:00 a.m. on Thursday, May 19, 2011 and continue until 2:00 a.m. on Wednesday, May 25, 2011.
