Driver's licence suspension set aside as provoked seizure's underlying cause was fully resolved.
The appellant appealed the Registrar of Motor Vehicles' decision to suspend his driver's licence due to a reported seizure.
The Registrar relied on a medical report indicating a seizure and the CCMTA Standards requiring a six-month seizure-free period.
The Tribunal found that while the appellant did suffer a provoked seizure caused by a brain abscess, the underlying condition had fully resolved following surgery and treatment.
Given the medical evidence, including clearance from his neurosurgeon and five months without further seizures, the Tribunal concluded the condition was not likely to significantly interfere with his ability to drive safely.
The suspension was set aside.
