The Board found that Biega, a service person, was at work on the application date and performed work falling within the labourers' bargaining unit, directing his ballot to be counted.
Conversely, the Board concluded that Vangerven did not perform bargaining unit work for any significant portion of the application date, and his ballot was excluded.
