DECISION OF THE BOARD; August 16, 2000
Decision
1The Board has received submissions from counsel for Giovanni Naccarato and certain other of the responding parties, and from the applicant. The responding party is seeking information that would be relevant only to a reconsideration request in Board File No. 3080-94-G, an application which they have not brought. The Board will not entertain a collateral attack on the Board’s decision in Board File No. 3080-94-G in any of the other proceedings.
2In order to assist counsel in determining whether or not to bring such an application, the Board will permit the examiner specified in his letter to examine the documents he has identified. This opportunity to inspect them will be held at the Board’s offices at 505 University Avenue, 2nd floor, Toronto, Ontario at 10:00 a.m. on Friday, August 18, 2000. The file will be in the custody of Warren Cox, Construction Co‑ordinator. Any examination of documents in the possession of the applicant’s counsel will take place at a place of their choosing, but not at the Board’s premises.
