The Registrar of the Alcohol and Gaming Commission of Ontario proposed to suspend the liquor licence of the respondent establishment for various violations of the Liquor Licence Act and its regulations.

Following a hearing where the Board found the licensee violated several provisions, including failing to post the liquor licence, failing to post an F.A.S.D. notice, lacking a partition separating the sidewalk from the premises, and bringing off-licence liquor onto the premises, the Board determined the appropriate sanction.

The Board issued a warning for the posting and menu violations, noting the licensee's prompt corrective actions.

However, for the partition and off-licence liquor violations, the Board imposed a four-day suspension of the liquor licence.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the liquor licence of the corporate licensee operating as Renegades.

The parties submitted an Agreed Statement of Facts admitting that the licensee permitted drunkenness and sold off-licence liquor on the premises, in violation of Ontario Regulation 719/90.

The Board accepted the Joint Submission on Disposition and ordered a 25-day suspension of the liquor licence.

The applicant sought a liquor licence for additional indoor and outdoor areas at its waterpark.

A resident living several blocks away objected, citing noise concerns from the outdoor pool area.

The tribunal found that the single objection did not establish that granting the licence was contrary to the public interest under section 6(2)(h) of the Liquor Licence Act.

The application was approved.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the liquor licence of Coalpot Restaurants Inc. for serving liquor outside prescribed hours, permitting an underage person to consume liquor, and permitting drunkenness.

The licensee admitted to the violations through an Agreed Statement of Facts.

The Board accepted a Joint Submission on Disposition, ordering a 21-day suspension of the licence and adding a condition regarding window coverings.

The Registrar proposed to refuse the renewal of the registrant's gaming assistant registration due to a recent conviction for theft under $5,000 related to a previous employment.

The registrant had participated in a workplace theft scheme but had since paid restitution and fully disclosed the conviction on his renewal application.

The Board found the registrant to be remorseful and unlikely to reoffend, noting his candour and positive employment record at the casino.

The Board ordered a 7-day suspension of the registration rather than a refusal to renew.

The Registrar of the Alcohol and Gaming Commission of Ontario issued Notices of Proposal to revoke and suspend the liquor licence of 1081165 Ontario Inc., operating as Club Paradise.

The allegations included overcrowding and permitting patrons to consume liquor in an unlicensed kitchen area.

At the hearing, the parties submitted an Agreed Statement of Facts and a Joint Submission on Disposition.

The Board accepted the joint submission and ordered a 30-day suspension of the liquor licence.

The Registrar issued a Notice of Proposal to suspend the licensee's liquor licence for 35 days, alleging that the licensee permitted drunkenness on the premises contrary to subsection 45(1) of O. Reg. 719/90.

The evidence indicated that two patrons were cut off from alcohol service when they showed signs of intoxication but were allowed to remain on the premises until they could safely return home.

The Board found that cutting off the patrons and allowing them to remain for safety reasons was prudent and did not constitute permitting drunkenness.

The Board made no finding of a violation.

The Registrar issued a Notice of Proposal to revoke the liquor licence of Ruby Matilda Wright, operating as Stephanie’s Caribbean Cuisine, and to refuse the transfer of the licence to Stephanie’s Caribbean Cuisine Inc. The Board found multiple serious violations of the Liquor Licence Act, including providing false information, contracting out the sale of liquor, and financial irresponsibility.

The evidence demonstrated that the licensee allowed her daughter to effectively operate the business and failed to ensure compliance with the Act.

Concluding that the licensee lacked the ability to operate the business with honesty, integrity, and due diligence, the Board ordered the immediate revocation of the liquor licence.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the liquor licence of 1428493 Ontario Inc., operating as Leao D'ouro Restaurante.

Following an inspection, the licensee was alleged to have committed several infractions, including failing to post the Fetal Alcohol Spectrum Disorder warning sign, failing to conspicuously post the liquor licence, lacking a required partition between the licensed area and the street, and possessing off-licence alcohol on the premises.

The Board found breaches regarding the warning sign, the posting of the licence, the lack of a drink list, the missing partition, and bringing off-licence liquor onto the premises.

However, the Board dismissed the allegation of keeping off-licence liquor for sale, accepting the licensee's evidence that the alcohol was purchased as a favour for catering clients and not sold or served on the premises.

The Board invited written submissions on sanction.

The Board of the Alcohol and Gaming Commission of Ontario previously ordered a 7-day suspension of the liquor licence for Dimmi Trattoria & Bar.

The licensee appealed the decision and obtained a stay, but later withdrew the appeal on consent.

The Board issued this order setting the suspension dates from April 1, 2007, to April 8, 2007, as proposed by the licensee.

The Registrar of Alcohol and Gaming issued a Notice of Proposal to revoke the liquor licence of Ruby Wright, operating as Stephanie's Caribbean Cuisine, and to refuse the transfer of the licence to Stephanie's Caribbean Cuisine Inc. The Board found that the licensee had contracted out the operation of the establishment to her daughter, who had an extensive criminal record and could not hold a licence herself.

The Board also found violations including unlawful sale of alcohol, failure to remit retail sales tax, operating after a cease and desist order, and providing false information on the transfer application by failing to disclose the daughter's full criminal record.

The application to transfer the licence was denied, and written submissions on penalty for the disciplinary matters were requested.

The Registrar of the Alcohol and Gaming Commission of Ontario issued Notices of Proposal to revoke the liquor licence of the Royal Canadian Legion Branch 360.

At the hearing, the Board considered whether the licensee had ceased to operate the business.

Based on uncontested evidence that the premises had been closed since June 2005 and the licensee had lost control of the premises, the Board found the licensee breached section 56 of Ontario Regulation 719/90 by failing to surrender its licence.

The Board ordered the immediate revocation of the liquor licence.

The licensee admitted to selling and serving liquor at 10:49 a.m., contrary to s. 25(1) of O. Reg. 719/90.

The Registrar withdrew the remaining allegation.

The Board accepted the joint submission and ordered a 7-day suspension of the liquor licence.

The Registrar issued a Notice of Proposal to suspend the brew on premise licence of the licensees.

Following an Agreed Statement of Facts, the licensees admitted to violations of Ontario Regulation 58/00, including failing to tag carboys, failing to provide invoices, and giving bottled wine to an inspector and police officer posing as customers.

The Board accepted a joint submission and ordered a 21-day suspension of the liquor licence.
