COURT OF APPEAL FOR ONTARIO
CITATION: Martel v. Ottawa (City), 2025 ONCA 148
DATE: 20250226
DOCKET: COA-24-CV-0810
Nordheimer, Gomery and Dawe JJ.A.
BETWEEN
Gabriel Martel
Plaintiff (Appellant)
and
City of Ottawa and Jeff DeLoyde
Defendants (Respondents)
Gabriel Martel, acting in person
Albert Brunet, for the respondents
Heard and released orally: February 25, 2025
On appeal from the order of Justice Sylvia Corthorn of the Superior Court of Justice, dated June 28, 2024.
REASONS FOR DECISION
[1] The appellant has not persuaded us that the motion judge made any errors of law, legal principle or palpable and overriding errors of fact. We see no error in her decision to allow this matter to proceed as a summary judgment motion, and no error in the motion judge’s analysis of the defence of qualified privilege. Finally, we do not find that the conduct of the hearing was unfair.
[2] The appeal is accordingly dismissed. Costs to the respondent fixed at $4,500 all-inclusive.
