Heard: September 8, 2010
On two motions to quash the appeal from the order of Justice Deena F. Baltman of the Divisional Court dated March 15, 2010.
APPEAL BOOK ENDORSEMENT
[1] The moving parties have made motions to quash the appellant’s appeal pursuant to s. 134(3) of the Courts of Justice Act.
[2] We agree with the moving parties that the appellant is in the wrong court. He has appealed an order of a single judge of the Divisional Court directly to this court. The appellant’s proper appeal route is to a panel of the Divisional Court on a motion under s. 21(5) of the Courts of Justice Act.
[3] The appeal is quashed.
[4] No costs.
