COURT OF APPEAL FOR ONTARIO
Feldman, Rouleau and Watt JJ.A.
BETWEEN:
Her Majesty The Queen
Respondent
and
Faical Labidi
Appellant
Counsel: Daniel J. Brodsky, for the appellant Craig Harper, for the respondent
Heard and endorsed: May 5, 2010 On appeal from sentence imposed by Justice John A. B. Macdonald of the Superior Court of Justice dated May 1, 1996.
APPEAL BOOK ENDORSEMENT
[1] The trial judge gave full and careful reasons for increasing the period of parole ineligibility to 15 years. He was entitled to infer from the evidence called that the appellant was a man whose character reflected a controlling attitude toward women and that the murder involved an aspect of planning in bringing the knife into the car. In our view, the trial judge made no error of principle and the sentence imposed was within the appropriate range.
[2] Leave to appeal sentence is granted but the appeal is dismissed.
