APPEAL BOOK ENDORSEMENT
[1] Unfortunately, we are of the view that the appeal is moot. The disposition which forms the subject of the proposed appeal has been overtaken by a subsequent disposition of the Board dated November 27, 2009. In our view, there is no pressing issue of law that would cause us to proceed with the appeal. In the event that the appellant chooses to appeal the new disposition, given this matter’s history, we would recommend that the appeal be expedited.
