The applicant trade union, CAW-Canada, applied under section 68 of the Labour Relations Act, 1995 for a declaration that it acquired the rights, privileges, and duties of the predecessor trade union, SEIU Local 183.
The Board found that all interested parties agreed or did not object to holding a representation vote.
The Board ordered a representation vote to determine whether CAW-Canada should succeed SEIU as the bargaining agent for the employees of Brown's Automatic Vending (1975) Ltd. The Board directed that all employees be voted together, with provisions to segregate ballots if any party contends there are separate full-time and part-time bargaining units.
