The appellant appealed as of right from a judgment of the Ontario Court of Appeal dismissing his appeal from a conviction for first degree murder.

The Supreme Court of Canada dismissed the appeal for the reasons of the majority of the Court of Appeal, finding that the trial judge adequately explained the defence position to the jury.
