The defendant, Michael R. Elliott, brought a motion to strike the plaintiff, Tahar Amrane's statement of claim without leave to amend, pursuant to Rules 21.01(1)(b), 21.01(3)(d), and 25.11 of the Rules of Civil Procedure.
Elliott, as manager of the Law Society of Ontario's Compensation Fund, had confirmed the rejection of Amrane's claim for compensation.
Elliott argued that the action should be struck because he benefited from statutory immunity under section 9 of the Law Society Act, he owed no private law duty of care to Amrane as a claimant to the Fund, and the action constituted an impermissible collateral attack on the Fund's decision.
The court agreed with Elliott, finding that Amrane's allegations did not establish bad faith, no private law duty of care existed, and the action was an abuse of process.
The motion to strike was granted, and leave to amend was denied.
Costs were awarded to Elliott in the amount of $200.
