On the merits, the Tribunal found the employer terminated the applicant based on a sincere, non-discriminatory belief that the applicant had submitted a fraudulent, backdated doctor's note.
The Tribunal also found no failure to accommodate prior to termination, as the employer had no suitable modified work available.
