An accused, found not criminally responsible for assault and mischief, was subject to a detention disposition at a psychiatric hospital.
Following an escalation in threatening behaviour towards the treating psychiatrist, the hospital significantly restricted the accused's liberties by placing him in a high-intensity treatment room and sought to transfer him to a higher-security facility.
The Ontario Review Board held an early review and restriction of liberty hearing.
The Board found that the restriction of liberty was warranted and the least restrictive option at the time.
The Board also found that the accused continues to pose a significant threat to public safety, particularly regarding psychological harm.
Concluding that a clinical impasse had been reached, the Board ordered the transfer as the least onerous and least restrictive disposition, with added conditions restricting internet access and prohibiting contact with specific individuals.
