REASONS FOR DISPOSITION

Introduction
[1]. On April 5, 2024, Mr. Jason Gregorios was found not criminally responsible on account of mental disorder on two counts of assaulting a police officer and one count each of assault with a weapon and assault causing bodily harm, all contrary to the Criminal Code of Canada.
[2]. By reason of a Disposition of the Ontario Review Board (“ORB”) dated November 21, 2024, Mr. Gregorios was discharged on certain terms and conditions. On August 19, 2025, the ORB convened a disposition hearing at Waypoint to conduct an early review of Mr. Gregorios’ Disposition. As a result of that hearing, the Disposition was amended to permit Mr. Gregorios to travel to Montreal, Quebec, from August 30 to September 3 in order to visit a sick relative. A new Disposition dated August 20, 2025, was issued for that purpose.
[3]. On September 10, 2025, Ms. Quesnelle, Clinical Liaison Coordinator at Waypoint wrote to the ORB to request an early hearing for the purposes of reviewing the Disposition dated August 20, 2025. The reason for the request was that the relative referenced above, had passed away on September 7, 2025. The hospital sought permission to allow Mr. Gregorios to travel to Montreal with his parents from September 19 to September 22, 2025, for the purposes of attending the funeral. Following an exchange of correspondence, Ms. Quesnelle, Mr. Evans, counsel for Mr. Gregorios and Mr. Perez, counsel for the Attorney General of Ontario, agreed to a virtual hearing for the purposes of the proposed amendment. It was agreed that any new Disposition issued by the ORB would not result in a change to Mr. Gregorios’ scheduled annual hearing date. It was further agreed that the hospital would not provide a new Hospital Report for the purposes of the hearing but would rely solely on the viva voce evidence of the attending psychiatrist.
Evidence at the Hearing
[4]. The Board had available the evidence and documents forming the Record, the Exhibits, and oral evidence from Dr. Ismail. Dr. Ismail is Mr. Gregorios’ attending psychiatrist. Dr. Ismail confirmed that the purpose of the requested amendment to the Disposition was to allow Mr. Gregorios the opportunity to travel to his aunt’s funeral in Montreal, accompanied by his parents. He further confirmed that the pass permitted by the previous amendment had taken place without issue and he did not anticipate any difficulties with the proposed plan for travel.
[5]. There were no questions of Dr. Ismail.
Disposition
[6]. The Board unanimously accepts the joint recommendation made by the parties. A new Disposition will permit Mr. Gregorios to travel to Montreal, accompanied by his parents, between September 19 and September 23, 2025. An extra day was added to the time span requested by the hospital in order to allow further time with his family following the funeral. The Board further orders that this amendment will not result in any change to the otherwise scheduled annual review of Mr. Gregorios’ Disposition.
