Minor variance for reconstruction of legal non-complying dwelling approved on consent subject to conditions.
The appellants appealed a minor variance application under section 45(12) of the Planning Act for the reconstruction and expansion of a legal non-complying single detached dwelling in the Municipality of Central Elgin.
The parties reached a settlement and requested the Tribunal to approve the minor variance subject to agreed-upon conditions.
The Tribunal found that the proposed minor variance and conditions had regard for matters of provincial interest, were consistent with the Provincial Policy Statement, and met the four-part test under section 45(1) of the Planning Act.
The Tribunal approved the minor variance subject to conditions.
