The claimant applied for a review of an Employment Standards Officer's refusal to issue an order for termination pay, alleging he was constructively dismissed due to continuous harassment and an alleged physical assault by his supervisor.

The Board found that the physical contact between the supervisor and the claimant was minimal and did not constitute an assault or a repudiation of the employment contract.

The Board also rejected the allegations of a campaign of harassment, finding that the employer had accommodated the claimant and that the claimant's subsequent resignation was voluntary.

The application was dismissed.

The applicant union referred a grievance to arbitration alleging that the responding party employer improperly laid off the grievor, who was the appointed shop steward, and that the layoff was a reprisal for his union activities.

The union argued that the collective agreement provided for a shop steward with super-seniority across all of the employer's job sites.

The Board dismissed the grievance, finding that the collective agreement only provided for job stewards on specific sites, not a shop steward with company-wide super-seniority.

The Board also found no evidence that the layoff was a reprisal, concluding it was a legitimate workforce reduction.

During the course of a hearing regarding an occupational health and safety appeal and a jurisdictional dispute, the parties entered into a Memorandum of Settlement.

The settlement resolved the appeal of a Ministry of Labour inspector's decision and the jurisdictional dispute concerning the installation of temporary lighting strings on construction projects.

The parties agreed that non-conductive material would be used for hanging and supporting temporary lighting strings and that workers would be instructed in safe installation.

The Board issued a decision reflecting the settlement, permitting the withdrawal of the jurisdictional dispute and terminating the health and safety appeal.

The settlement resolved the appeal of a Ministry of Labour inspector's decision and the jurisdictional dispute concerning the installation of temporary lighting strings on construction projects.

The parties agreed that non-conductive material would be used for hanging and supporting temporary lighting strings and that workers would be instructed in safe installation.

The Board issued a decision reflecting the settlement, permitting the withdrawal of the jurisdictional dispute and terminating the health and safety appeal.
