The complainant union alleged that the respondent employer violated section 24 of the Occupational Health and Safety Act by issuing written warnings to thirty workers who refused to work on a conveyor line they believed was unsafe.
The workers initially refused to work after the line 'jumped'.
They continued their refusal the following day, even after repairs were made and a Ministry of Labour inspector had investigated and concluded the line was not likely to endanger them.
The Ontario Labour Relations Board found that, following the employer's explanations and the inspector's report, the workers did not have reasonable grounds to continue their work refusal.
The Board held that the refusal was not protected by the Act and that the employer's mild disciplinary response was justified.
The complaint was dismissed, with one Board member dissenting.
