The arbitrator found that the union's revised particulars did not establish a prima facie case of discrimination on any of the alleged grounds, as there was no evidence the employer knew or ought to have known of the grievor's mental health disability or psoriasis, nor was there evidence of differential treatment based on race or ethnicity.
Consequently, the arbitrator concluded that the grievance was moot because the primary remedy of reinstatement had already been provided and no live controversy remained.
The grievance was dismissed.
