ORAL REASONS FOR DECISION:
[1] The applicant seeks judicial review of a decision of the City of Toronto’s Administrative Penalty Tribunal. The applicant’s father Michael was issued a penalty order of $93.25 in March of 2025 because a vehicle registered to Michael was caught by a speed camera for speeding in a community safety zone. The applicant was permitted to act as his father’s agent in the Tribunal proceedings and was the driver of the vehicle at the relevant time.
[2] The respondent raises standing as a preliminary issue. The proper parties to an application to judicially review this penalty order are prescribed by the Highway Traffic Act, s. 21.1(9), and do not include a person who acted as agent before the Tribunal or the driver of the vehicle. The applicant has not shown that he has standing on any other basis.
[3] The applicant’s father is not a party to these court proceedings but the applicant submits that change could be made if necessary.
[4] Having considered the Highway Traffic Act, standing principles and the submissions of the applicant, we conclude that he does not have standing but his father does. The Title of Proceedings shall be amended to substitute his father as the applicant and this hearing shall be adjourned so that the new applicant can attend. The applicant may attend with his father and assist him, and may ask the panel hearing the application about the scope of that assistance.
[5] This hearing is adjourned. The City is not asking for costs of today.
