REASONS FOR DECISION
[ 1 ] Paragraph one of the order dated June 20, 2025, is an interlocutory order. It does not bar the respondents from relying on the findings made by Justice Koehnen in his reasons dated June 16, 2021, reported at 2021 ONSC 4281 , upheld at this court at 2023 ONCA 745 .
[ 2 ] The appeal is therefore quashed.
[ 3 ] The costs of this motion are to the moving party on a partial indemnity scale fixed in the amount of $7,000 inclusive of disbursements and HST.
