On review of the order of Justice Patrick J. Monahan of the Court of Appeal for Ontario, dated October 7, 2025.
REASONS FOR DECISION
[ 1 ] The request to review the order of Justice Monahan is dismissed. The appellant has not demonstrated any error in Justice Monahan’s finding that the moving party’s appeal is without merit. Given that finding, the moving party was not entitled to a stay of the judgment under appeal. Similarly, the moving party failed to demonstrate any error in Justice Monahan’s findings that he (the moving party) had no legal entitlement to the other relief requested in his notice of motion.
[ 2 ] The moving party’s request in his notice of motion to this panel for relief in addition to a review of Justice Monahan’s order is also dismissed. The moving party has not demonstrated any legal entitlement to any of the additional relief sought nor filed any admissible evidence to support his request.
[ 3 ] Costs of the motion are to the responding party on a partial indemnity scale fixed in the amount of $1,500 inclusive of disbursements and HST.
