COURT OF APPEAL FOR ONTARIO
DATE: 20251211
DOCKET: COA-25-CR-0695
Zarnett, Dawe and Madsen JJ.A.
IN THE MATTER OF: Reza Hashemi Paraiso
AN APPEAL UNDER PART XX.1 OF THE CRIMINAL CODE, R.S.C. 1985, c. C‑46
Jeff Marshman, for the appellant
Ryan Mullins, for the respondent, the Attorney General of Ontario
Jessica Szabo and Anne Marshall, for the respondent, the Person in Charge, Ontario Shores Centre for Mental Health Sciences
Heard and rendered orally: December 10, 2025
On appeal from the Disposition of the Ontario Review Board, dated April 30, 2025, with reasons dated May 22, 2025.
REASONS FOR DECISION
[1] Counsel provided an update this morning. The appellant is now residing at Halsey Lodge, a group home. This is a substantial change from the circumstances that were before the Ontario Review Board (the “Board”) when the Disposition under appeal was made.
[2] Appellant’s counsel fairly concedes that there is little practical purpose in proceeding with the appeal. The Board will be better situated to address the appropriate Disposition, including any terms regarding cannabis use, at the next annual review in April 2026, on the then current facts.
[3] The appeal is accordingly dismissed.
