COURT OF APPEAL FOR ONTARIO
DATE: 20240402 DOCKET: C68090
Judges: Simmons, Hourigan and Paciocco JJ.A.
BETWEEN:
His Majesty the King Respondent
and
Ralfina Burnett Appellant
Counsel: Mark Halfyard, for the appellant Jacob Millns, for the respondent
Heard and released orally: March 28, 2024
On appeal from the conviction entered on September 17, 2019 by Justice Michael T. Doi of the Superior Court of Justice, sitting without a jury.
Reasons for Decision
[1] The Crown concedes that the trial judge erred in finding that the stated interest rate for the CIBC bank account was 21%.
[2] On our reading of the trial judge’s reasons, the mistaken finding concerning the interest rate played no material role in his determination that the fraud charge had been proven beyond a reasonable doubt.
[3] Prior to the oral hearing, the appellant abandoned her second ground of appeal.
[4] The appeal is therefore dismissed.

“David M. Paciocco J.A.”
