COURT OF APPEAL FOR ONTARIO
DATE: 20230818 DOCKET: C69070
Hourigan, Brown and Monahan JJ.A.
BETWEEN
His Majesty the King Respondent
and
Jeffrey Visscher Appellant
Counsel: Bryan Badali, for the appellant Emily Bala, for the respondent
Heard and released orally: August 17, 2023
On appeal from the convictions entered on October 22, 2022 by Justice Thomas J. Carey of the Superior Court of Justice.
Reasons for Decision
[1] The appellant appeals his convictions for assaulting his then wife, the complainant, on May 13, 2016, and breaking and entering into the complainant’s house and committing the indictable offence of assault. A sentence of two years less a day, followed by three years’ probation, was imposed.
[2] At the hearing, the appellant informed the court that he was abandoning the ground of appeal advanced in his factum that the verdicts were unreasonable. The appellant now advances a single ground of appeal that legal error infected the trial judge’s assessment of the credibility of the evidence given by complainant and R.W.
[3] The appellant has not demonstrated any such legal error to us. We see no basis upon which to interfere with the verdicts.
[4] The appeal is dismissed.
