Reasons for Decision

[1] The moving party seeks to review the December 2, 2022 order of a single judge of this court.

[2] At the beginning of the hearing of the motion, the moving party sought an adjournment alleging that counsel for the responding party had changed without delivering a notice of change of solicitors and that the font and the date stamp on his filed motion record had been changed. We dismissed the adjournment request because it was without any foundation.

[3] The moving party’s review motion is without any merit. The order under review contains no error. Indeed, it is helpful to the moving party in that it provided directions about the form of the order to be filed and relief from compliance with the rules, and extended the time to perfect his motion for leave to appeal.

[4] The review motion is therefore dismissed. The moving party will have a final 30-day extension from today to perfect his motion for leave to appeal. The moving party shall forthwith pay costs of this motion in the amount of $500 to the responding party.

[5] The formal order will be taken out by the responding party. The order will provide that the review motion is dismissed with costs of $500 to be paid forthwith by the moving party to the responding party. The moving party’s approval of the draft order is hereby dispensed with.
