[1] Following dismissal of the motion for leave to appeal with costs, the moving party complained that it was not given the opportunity to make submissions as to costs. The parties were therefore invited to provide submissions. The responding party has provided submissions indicating that it is content with the costs award made by the panel. It has also provided a bill of costs that supports the amount awarded. The moving party has not provided any further submissions.

[2] We are satisfied that the original costs order was fair. Accordingly, the original order will stand.
