The Claimant sought compensation for the expropriation of a multi-tenant commercial property by the Ministry of Transportation.
Prior to the hearing, the parties settled the market value at $3,200,000 and business loss at $507,000.
The remaining issues were the commencement date for interest and a request for an increased interest rate of 12% due to alleged delay.
The Tribunal dismissed the claim for increased interest, finding it was not pleaded and there was no undue delay.
The Tribunal also held that productive use of the property ceased on February 28, 2018, when the last tenants vacated, and interest should commence from that date.
