The applicant trade union applied for certification to represent a bargaining unit of paramedics and emergency medical dispatchers employed by the City of Toronto.
This was a partial displacement application seeking to carve out portions of three existing bargaining units represented by two incumbent unions.
The employer and incumbent unions argued the proposed unit was inappropriate and filed notice under section 8.1 of the Labour Relations Act.
The Board declined to follow its conventional practice of holding a representation vote and sealing the ballot box, noting that voting the existing 17,000-employee units would be a huge undertaking and highly disruptive.
Instead, the Board directed the applicant to prove its trade union status and referred the matter to the Registrar to schedule a hearing to determine the appropriate bargaining unit before any vote is held.
