Decision of the Board
1This is an application under section 68 of the Employment Standards Act, R.S.O. 1990 c. E-14, as amended (the "ESA") for review of an Order to Pay.
2This application was scheduled for hearing before the Board at 9:30 a.m. on December 5, 2001. At that time, neither the applicant nor the responding party employee (nor a representative of either party) appeared at the hearing. After waiting the normal thirty (30) minutes, the Board convened the hearing and dismissed the application in the circumstances.
3The Board directs the Director, Employment Standards to pay out the monies held in trust, less the administration fees, as well the interest accumulated thereon to the claimant.
