The applicant appealed the City of Burlington's failure to make a decision on Official Plan and Zoning By-law amendment applications for a mixed-use development.
The parties reached a settlement for a revised proposal featuring 18-storey and 9-storey buildings with 555 residential units and a public park.
The Tribunal accepted uncontroverted expert planning evidence that the revised proposal is consistent with the Provincial Policy Statement, conforms to the Growth Plan and Halton Region Official Plan, and represents appropriate intensification within a Major Transit Station Area.
The appeals were allowed in part, with the final order withheld pending finalization of the planning instruments and technical reports.
