The applicant filed a complaint with the Child and Family Services Review Board regarding services received from the respondent children's aid society.
The respondent moved to dismiss the application, arguing the complaints were already before the court in ongoing child protection proceedings.
The Board found that most of the applicant's complaints, which related to access terms and conditions, were substantively related to the issues before the court and therefore outside the Board's jurisdiction under s. 120(8)(a) of the Child, Youth and Family Services Act, 2017.
However, the Board found it had jurisdiction to hear one distinct service complaint regarding whether the applicant's concerns about a specific child protection worker were heard.
