Introduction

1This is an Application filed under section 120 of the Child, Youth and Family Services Act, 2017, S.O. 2017, c.14, Sched. 1, (the “Act”).

3The Applicant has abandoned the Application and it must be dismissed.

ANALYSIS

4Following a scheduled Pre-Hearing/Mediation on February 6, 2025, the CFSRB sent the parties a Pre-Hearing/Mediation Report, (the “Report”) providing directions to the parties.

5The Report was sent to the Applicant’s email address on file and it was not returned as undeliverable.

6Paragraph 7 of the Report set out:

The Applicant is to advise the CFSRB by February 20, 2025, copying the Respondent:

a. Whether she wishes to continue the pre-hearing/mediation, and if so, to provide three dates she is available prior to February 28, 2025.

b. If the Applicant does not wish to continue with the pre-hearing/mediation, but wants to proceed with her Application. If so, the CFSRB will schedule a pre-hearing to prepare for the hearing of the matter.

6Paragraph 8 of the Report set out that if the CFSRB does not hear from the Applicant by February 20, 2025, the CFSRB may close the file. The Applicant received notice through the Report that if she did not follow the directions set out in the Report, the CFSRB may close the file.

7The CFSRB did not hear from the Applicant by February 20, 2025 or at any time up to today. I conclude that the Applicant has abandoned her Application and it must be dismissed.

ORDER

8The Application is dismissed.
