Appeals allowed and strata severances granted for a retirement residence and apartment building following a settlement.
Claridge Homes and the City of Ottawa appealed a Committee of Adjustment decision refusing a consent application for strata severances at 1705 Carling Avenue.
The application sought to create two parcels for a retirement residence and a residential rental apartment building, connected by a shared underground parking garage.
The Tribunal held a settlement hearing and, based on uncontroverted expert planning evidence, found that the proposed severances satisfied the criteria under the Planning Act, were consistent with the Provincial Policy Statement, and conformed to the City's Official Plan and Zoning By-law.
The appeals were allowed and the consents were granted subject to conditions.
