Following a highway accident, a plaintiff sued two co-defendants for property damage.
Over two years later, one co-defendant initiated an action against the other for damages to its vehicle, prompting a cross-demand.
The first co-defendant later withdrew its action and sought to dismiss the cross-demand on the basis that it was prescribed.
The Supreme Court of Canada held that under article 2224 of the Civil Code, the interruption of prescription caused by the plaintiff's initial action benefits all parties to the action, including co-defendants against each other.
The appeal was allowed and the exception to dismiss was rejected.
